Terms of service

These terms cover the use of dotcomdesign.online and the general basis on which .comdesign provides web design and development services. Individual projects are governed by the written proposal and quote you approve, which takes precedence over anything on this page if the two disagree.

Quotes and pricing

Prices shown on this website are starting points in Canadian dollars and are indicative, not binding offers. Every project receives a fixed written quote before work begins, based on the scope we agree together. The figure you approve is the figure you pay; changes to scope after approval are quoted separately before we act on them.

Payment

Unless your proposal says otherwise, we invoice 50% before starting and 50% on launch. Work begins once the deposit clears. Final files, hosting transfers and domain handovers take place after the closing invoice is settled.

Your responsibilities

Projects run on the schedule we agree, and that schedule assumes timely delivery of your content, images, logins and feedback. You confirm that any text, photography or logos you supply are yours to use, or that you hold the necessary licences. We are not responsible for third-party claims arising from material you provide.

Ownership

On final payment, ownership of the design and the custom code we wrote for your project transfers to you. Third-party components — themes, plugins, fonts, stock photography and platform software such as WordPress or Shopify — remain governed by their own licences. We keep the right to display finished work in our portfolio unless you ask us in writing not to.

What we can and cannot promise

We build to current web standards and test on real devices before launch. Search rankings, traffic levels, conversion rates and revenue depend on factors outside our control, including competition, search engine algorithm changes and your own marketing. Figures shown on this website describe results achieved on past projects and are not a guarantee of future outcomes.

Support after launch

Every project includes 30 days of post-launch tuning for issues arising from our build. Ongoing hosting, updates, backups and content edits are covered by a separate care plan. Faults caused by third-party changes, or by edits made by others after handover, are quoted as new work.

Liability

Our total liability for any project is limited to the fees you have paid us for that project. We are not liable for indirect or consequential losses, including lost profits or lost data. Nothing here limits liability that cannot be limited under Ontario law.

Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply within it.
